Terms & Conditions

These Terms & Conditions apply to all bookings, reservations, tours, treks, expeditions, transportation, accommodation, and other travel services arranged by Himalayan Sunrise Trekking & Expedition Pvt. Ltd.
By making a booking with us, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
1. Booking and Confirmation
1.1 All enquiries and bookings are subject to availability.
1.2 A booking will be considered confirmed once the required deposit or payment has been received and written confirmation has been issued by Himalayan Sunrise.
1.3 Booking confirmation and relevant trip information will normally be provided by email.
1.4 The person making the booking is responsible for ensuring that all information provided to us is accurate and complete.
1.5 Any special requests, including accommodation, dietary requirements, transportation, or other services, are subject to availability and should be confirmed in writing.
2. Prices and Payments
2.1 All prices will be quoted in the currency stated in the booking or invoice.
2.2 Prices are subject to availability and may change before a booking is confirmed.
2.3 Once a booking has been confirmed, the agreed price will normally apply, except where additional costs arise from changes requested by the traveler, government-imposed fees, taxes, permits, transportation changes, or other costs outside our reasonable control.
2.4 The remaining balance must be paid by the date stated on the invoice or booking confirmation.
2.5 Bank charges, payment gateway charges, currency conversion fees, and other transaction costs may be payable by the traveler where stated in the booking or invoice.
2.6 Failure to pay the required balance by the agreed deadline may result in cancellation of the booking and the application of the applicable cancellation charges.
3. Travel Documents, Passport and Visa
3.1 It is the traveler's responsibility to obtain and maintain all documents required for travel, including:
3.2 Many countries require passports to have at least six months' validity from the date of entry. Travelers should confirm the requirements applicable to their nationality and destination before travelling.
3.3 Himalayan Sunrise cannot be responsible for costs, delays, denied boarding, denied entry, fines, penalties, or other expenses arising because a traveler does not hold the required travel documents.
4. Travel Insurance
4.1 All travelers are strongly required to have comprehensive travel insurance covering the entire duration of their trip.
4.2 Depending on the nature of the trip, insurance should include appropriate cover for trekking and adventure activities, medical treatment, emergency evacuation, cancellation, interruption, loss of baggage, and other relevant risks.
4.3 Travelers participating in high-altitude trekking should ensure that their insurance specifically covers the maximum altitude and activities included in their itinerary.
4.4 Himalayan Sunrise may request evidence of valid travel insurance before the commencement of a trip.
5. Health and Fitness
5.1 Travelers are responsible for ensuring that they are medically and physically suitable for their chosen trip.
5.2 Travelers should obtain appropriate medical advice before participating in trekking, high-altitude activities, or other physically demanding activities.
5.3 Travelers must inform Himalayan Sunrise of any relevant medical condition, allergy, dietary requirement, or other circumstance that may reasonably affect their participation or safety.
5.4 On trekking and expedition trips, itineraries may be changed where reasonably necessary because of a traveler's health, safety, weather, altitude, trail conditions, or other circumstances.
6. Trekking and Adventure Activities
6.1 Trekking and adventure travel involve inherent risks, including difficult terrain, altitude, weather changes, landslides, avalanches, road conditions, flight delays, illness, injury, and other unforeseen circumstances.
6.2 Travelers are expected to follow the reasonable instructions of their guide and trip leaders concerning safety, route changes, altitude acclimatization, weather, and other matters.
6.3 Himalayan Sunrise reserves the right to alter, postpone, shorten, or change a route where reasonably necessary for safety or operational reasons.
6.4 In remote mountain areas, medical facilities and transportation may be limited. Emergency evacuation may be necessary and may result in additional costs. Travelers should ensure that their travel insurance covers such expenses.
7. Cancellation by the Traveler
7.1 Cancellation requests must be made in writing, normally by email.
7.2 The cancellation date will be the date on which Himalayan Sunrise receives the written cancellation request.
7.3 Cancellation charges will apply according to the following schedule:

7.4 The above cancellation charges may be increased where specific non-refundable costs have already been incurred for the traveler, including flights, permits, hotels, transportation, accommodation, or other third-party services.
7.5 Any refund will be calculated after deducting applicable cancellation charges and non-refundable costs.
7.6 Certain special bookings, group bookings, restricted-area permits, expedition arrangements, airline tickets, accommodation, or other services may have different cancellation conditions. Where applicable, these conditions will be advised to the traveler before confirmation.
8. Changes to a Confirmed Booking
8.1 Requests to change dates, routes, accommodation, transportation, group size, or other arrangements may be subject to availability and additional charges.
8.2 Any additional costs resulting from a change requested by the traveler will normally be payable by the traveler.
8.3 Changes requested shortly before departure may be treated as a cancellation and new booking, depending on the circumstances and costs already incurred.
9. Voluntary Withdrawal and Unused Services
9.1 If a traveler voluntarily leaves or withdraws from a trip after it has commenced, no refund will normally be provided for unused services.
9.2 No refund will normally be provided for accommodation, transportation, meals, sightseeing, permits, guide services, or other services that are included in the itinerary but are not used by the traveler.
9.3 If a traveler is unable to continue a trek for medical, personal, or other reasons, any additional transportation, accommodation, evacuation, or other expenses will normally be the traveler's responsibility unless covered by applicable insurance.
10. Changes or Cancellation by Himalayan Sunrise
10.1 Himalayan Sunrise will make reasonable efforts to operate trips according to the confirmed itinerary.
10.2 However, we may modify an itinerary, accommodation, transportation arrangements, or route where reasonably necessary because of weather, natural disasters, road or trail conditions, government decisions, flight cancellations, safety concerns, operational circumstances, or other events beyond our reasonable control.
10.3 Where a significant change is required before departure, we will make reasonable efforts to inform the traveler and, where appropriate, offer a suitable alternative.
10.4 Where a trip cannot operate because of circumstances beyond our reasonable control, any refund will be considered after taking account of amounts already paid to and retained by third-party suppliers and other unavoidable costs.
11. Force Majeure and Unavoidable Circumstances
Himalayan Sunrise shall not be responsible for delays, additional expenses, changes, interruption, or cancellation caused by circumstances beyond our reasonable control, including but not limited to:
We will make reasonable efforts to assist travelers affected by such circumstances.
12. Flights and Transportation
12.1 Domestic and international flights are subject to the conditions of the relevant airline.
12.2 Flight schedules may change or be cancelled because of weather, operational reasons, technical issues, government restrictions, or other circumstances.
12.3 Himalayan Sunrise will assist travelers where reasonably possible, but any additional costs resulting from flight delays, cancellations, rescheduling, or missed connections may be payable by the traveler unless otherwise agreed or covered by insurance.
13. Accommodation
13.1 Accommodation will be provided according to the category stated in the confirmed itinerary.
13.2 Where the specified hotel is unavailable or circumstances require a change, Himalayan Sunrise may arrange accommodation of a similar standard where reasonably possible.
13.3 Any special room requests are subject to availability.
14. Guides, Porters and Staff
14.1 Himalayan Sunrise will arrange appropriately qualified guides and support staff according to the nature of the trip.
14.2 Travelers must treat guides, porters, drivers, hotel staff, and other service providers respectfully.
14.3 Where required by Nepalese law or applicable regulations, Himalayan Sunrise will arrange the required insurance and contractual arrangements for trekking staff.
The Travel and Trekking Agency Rules, 2062 contain specific requirements concerning contracts and insurance for workers accompanying tourists.
15. Liability
15.1 Himalayan Sunrise will exercise reasonable care in arranging the services included in your booking.
15.2 We may use independent third-party suppliers, including airlines, hotels, transportation companies, insurance companies, and other service providers.
15.3 We are not responsible for the acts, omissions, delays, or failures of independent third-party suppliers to the extent that such matters are outside our reasonable control.
15.4 Nothing in these Terms & Conditions is intended to exclude or limit any liability or consumer right that cannot lawfully be excluded or limited under applicable Nepalese law.
16. Personal Information and Privacy
16.1 We will make reasonable efforts to keep personal information provided to us secure.
16.2 However, no Internet transmission or electronic storage system can be guaranteed to be completely secure.
16.3 We may use personal information for legitimate purposes connected with providing our services, including:
16.4 We will not knowingly use personal information for purposes unrelated to the provision of our services without an appropriate basis for doing so.
17. Consumer Rights
Himalayan Sunrise respects the rights and protections provided to consumers under applicable Nepalese law.
The Consumer Protection Act, 2075 provides consumer rights relating to quality services, access to services, fair and competitive pricing, and remedies provided by law.
Nothing in these Terms & Conditions is intended to remove or restrict a consumer right that cannot legally be excluded.
18. Complaints
18.1 If you have a concern during your trip, please inform your guide, trip leader, or Himalayan Sunrise as soon as reasonably possible so that we have an opportunity to address the matter.
18.2 Complaints that cannot be resolved during the trip should be submitted to Himalayan Sunrise in writing as soon as reasonably practicable after completion of the trip.
18.3 We will review complaints fairly and make reasonable efforts to resolve legitimate concerns.
19. Applicable Law
19.1 These Terms & Conditions and the services provided by Himalayan Sunrise are governed by the applicable laws of Nepal.
19.2 The Tourism Act 2035 and the Travel and Trekking Agency Rules 2062 form part of the regulatory framework applicable to travel and trekking agencies in Nepal.
19.3 Nothing in these Terms & Conditions is intended to override any mandatory provision of Nepalese law.
20. Amendments to These Terms & Conditions
Himalayan Sunrise may update these Terms & Conditions from time to time to reflect changes in our services, applicable regulations, or business practices.
The Terms & Conditions applicable to a confirmed booking will be those provided to or accepted by the traveler at the time of booking, unless a later change is required by law or agreed by the parties.
21. Acceptance of Terms
By making a booking, paying a deposit, or confirming participation in a trip with Himalayan Sunrise Trekking & Expedition Pvt. Ltd., the traveler confirms that they have read, understood, and accepted these Terms & Conditions.
